TERMS OF SERVICE

This is the boring-but-necessary page. I've written it in plain English instead of legal fog, because a page you can't read protects nobody. It still means what it says.

Who you're dealing with

Spiral Collectibles is a trade name of The Spiral Collective LLC, a Colorado limited liability company.

When you see "I," "me," or "we" below, that's Spiral Collectibles. "You" is whoever is using the site.

Agreeing to this

Using spiralcollectible.com — browsing it, buying from it, signing up for email — means you accept these terms. If you don't accept them, please don't use the site.

My Refund Policy, Shipping Policy, and Privacy Policy are part of this agreement too. They cover returns, delivery, and what happens to your information, and nothing here overrides them.

Who can buy

You need to be 18 or older, or have a parent or guardian handling the purchase. I ship to the United States only, including APO, FPO, and DPO addresses. Outside the US, email me and I'll quote it by hand.

What I sell, and what that means

Almost everything here is used, vintage, or out of production, and almost every item is one of one. When it's gone, it's gone — there's no back room with another one.

I describe condition honestly and photograph every item myself, including the flaws. Those descriptions are my good-faith opinion as a collector, not a certification. Grading is subjective, and two collectors can look at the same paint wear and land in different places. If my photos don't answer your question, ask me before you buy — I'd much rather answer a question than process a return.

Nothing I sell is authenticated or graded by a third party unless the listing specifically says so and shows the certificate. I don't sell autographed items as authenticated.

Colors shift between screens. A figure that reads navy on your phone may read black on your laptop. That's monitors, not misrepresentation.

These are collectibles, not children's toys

This one matters, so read it.

Vintage items were made under the safety standards of their day, not today's. Many have small parts, sharp edges, brittle plastic, aging paint, or old batteries and wiring. They have not been tested against current toy safety regulations, and I'm not able to test them.

Everything on this site is sold as a collectible for display, for buyers 14 and older. Nothing here is sold as a toy for a child to play with. Please keep vintage pieces away from small children, and don't hand a forty-year-old electronic toy to a kid to chew on. Use your judgment — that's on you, not on me.

Prices, and honest mistakes

Prices are in US dollars and don't include shipping or tax, which are calculated at checkout before you pay.

I price a lot of items by hand, and sometimes I'll get one wrong — a decimal in the wrong place, a listing that says $2 when it should say $200. If an item is obviously mispriced, I'll cancel the order and refund you in full rather than ship it. You'll hear from me the same day. I'm not going to pretend a typo was a sale, and I'd ask you not to either.

The same goes if two orders come in for the same one-of-one item at the same moment. First paid order wins; the second gets a full refund and an apology.

When your order is actually an order

The confirmation email you get right after checkout means I received your order — not that I've accepted it. The order is accepted when I ship it and send you tracking.

Until then I can cancel and refund for the reasons above: a pricing error, an item that sold twice, or a listing that turned out to be wrong once I had it in hand. I'll refund the full amount, including shipping. That's the whole remedy — I'm not able to eat the difference on a mispriced item.

Payment

Payments run through Shopify Payments and the wallets it supports. I never see or store your full card number. You're confirming the payment method is yours and there's money behind it.

Colorado sales tax is added where the law requires it.

Shipping and returns

Both have their own pages, and both are more generous than this page's tone suggests. Short version: orders go out in three to five business days, everything ships with tracking, sealed items have 30 days and loose items have 14 from the delivery scan, and if I got it wrong I pay the return shipping. Read the Shipping Policy and Refund Policy for the real detail.

Risk of loss passes to you when the carrier delivers the package. If it's lost or damaged in transit, tell me and I'll file the claim — the Shipping Policy explains exactly how and by when.

Trademarks, and who owns what

Spiral Collectibles is an independent reseller of secondhand collectibles. I am not affiliated with, authorized by, sponsored by, or endorsed by Lucasfilm, Disney, Paramount, CBS, Hasbro, Mattel, Marvel, DC Comics, Warner Bros., Funko, McFarlane Toys, Jazwares, NECA, Playmates, Microsoft, or any other rights holder whose products appear here.

Star Wars, Star Trek, Transformers, G.I. Joe, Masters of the Universe, Halo, and every other name, logo, and character on this site are trademarks of their respective owners. I use those names only to identify what an item actually is, which is what the law allows a resale shop to do. All rights stay with the owners.

The Spiral Collectibles name, the spiral badge, my product photography, and my written descriptions are mine. Please don't lift the photos or copy the listing text — a lot of those descriptions took longer to write than the photos took to shoot. You're welcome to share links to any page here.

What you can't do here

Don't scrape the site, hammer it with bots, resell my photos or copy, try to break into any part of it, place fraudulent orders, or use the site for anything illegal. I can refuse or cancel an order, and close an account, if any of that is going on.

Anything you post

If you leave a review, a comment, or send me a photo, you're giving me permission to show it on the site and in social posts, with your first name. You keep ownership of it. Keep it legal and keep it yours — don't post someone else's photos or writing. I can remove anything, but I'm not obligated to monitor everything, and a review that's up doesn't mean I've endorsed what it says.

The legal limits

The site is provided as it is. I can't promise it will never go down, never show a stale price, or never have a broken link.

Everything I sell is secondhand and sold as-is, described as accurately as I know how. To the extent Colorado law allows it, I'm disclaiming the implied warranties — merchantability, fitness for a particular purpose — because a 1978 Death Star playset can't honestly carry them. This does not take away the return rights in my Refund Policy, and it does not take away any right you have under consumer protection law that can't be waived.

My total liability to you for any order is capped at what you paid for that order. I'm not liable for indirect or consequential losses — lost resale value, lost profit, or the collection you were building around the piece.

None of this limits liability for fraud, or for anything the law says can't be limited.

If we disagree

Email me first. Almost everything gets solved in one message, and I'd rather fix it than argue about it.

If that doesn't work, these terms are governed by the laws of the State of Colorado, without regard to conflict of law rules, and any dispute goes to the state or federal courts in Arapahoe County, Colorado.

Changes

I may update these terms. The version posted here on the day you place an order is the one that governs that order. If I change something significant, I'll update the effective date at the top.

The rest of it

If a court strikes one part of this page, the rest still stands. If I don't enforce something once, I haven't given up the right to enforce it later. These terms, plus the shipping, refund, and privacy policies, are the whole agreement between us.
